    This policy explains how we, TaiTaiPiePies Limited (hereinafter referred to as “TTPP”), use the personal information which you provide to us when using our service, including but not limited to our website and mobile applications (jointly referred as “Website”). Please read this Privacy Policy and understand it before using our services. By visiting and/or ordering services on this Website, you agree and, where required, consent to the collection, use and transfer of your information as set out in this policy.


  2. What information do we collect about you?

    We collect personal information from you when you order goods or services from us or use our Website. Website usage information may also be collected using cookies (as defined below). TTPP will collect information that personally identifies you and/or your location, where required (this may include your name, email address, home address, telephone number, geolocation, etc.), but only when you voluntarily give it to us. We collect this information exclusively to carry out the functions offered on the Website and to provide you with offers and information about TTPP and other services we think you may be interested in. We might collect this personal information through: online food ordering; entry into competitions; subscribing to our newsletter; creating a user account; sending 'contact us' messages or other correspondence through the Website; or through advertising, research and direct marketing. We do not collect sensitive information about you.

    Some of the information collected will not personally identify you but will instead track your use of the Website so that we can better understand how the Website is used by customers and in turn enhance and improve your experience in ordering food.   4. Storage and security of your personal information

    TTPP will use all reasonable endeavours to maintain the security of your personal information and to protect your personal information from misuse, interference and loss and against unauthorised access, modification or disclosure. TTPP will destroy any personal information it holds about you which it no longer requires under the terms of this Privacy Policy. Where you have chosen a password to access certain services of the Website, you are responsible for keeping your password confidential. We recommend not sharing your password with anyone. Due to the nature of the internet, TTPP does not provide any guarantee or warranty regarding the security of your personal information during transmission to us or storage by us and you acknowledge that you disclose your personal information to us at your own risk. Please contact us immediately if you become aware or have reason to believe there has been any unauthorised use of your personal information in connection with the Website.

    You consent to TTPP collecting and using your personal information for processing and delivering the order/s placed on the Website and any other service provided through the Website. In particular you expressly consent that TTPP may disclose your personal information, including your name, email address, physical address and telephone number to riders delivering your order, either employed by TTPP or by third parties providing delivery services to TTPP. You consent to TTPP using your personal information for advertising and direct marketing purposes in order to inform you about the Website and the goods and services it provides, or other matters that it believes will be of interest to you. TTPP may disclose your personal information, and you consent to the disclosure of your personal information, to:
    other entities within the TTPP group of companies; and
    third parties engaged by TTPP or other members of the TTPP group to perform functions or provide products and services on our behalf such as processing payments, mail outs, debt collection, research, statistical information, marketing and direct or indirect advertising.

TTPP reserves the right to disclose your personal information if it is required or authorised to do so by law, or, if it is reasonably necessary in its opinion to protect the rights or property of TTPP or any third party, or to avoid injury to any person. If the TTPP business is sold or merges with another entity then some or all of your personal information may be passed to a third party.


  6. Access to your information

    TTPP will use all reasonable endeavours to keep personal information it holds accurate, complete, up-to-date, relevant and not misleading. Please contact us if you would like to access the personal information TTPP holds about you. We will use reasonable endeavours to provide a complete list of your personal information within a reasonable period of receipt of your request. TTPP reserves the right to charge a nominal fee for the processing of this request in accordance with local legislation. You may contact us to correct any of your personal information that is inaccurate, incomplete or out-of-date, or to request that your personal information be deleted. We will use reasonable endeavours to correct or delete your personal information as requested within a reasonable period of receipt of your request. Deletion of your account with TTPP will not automatically delete the personal information held about you. If you would like TTPP to delete all personal information together with the deletion of your account, please follow the steps mentioned-above. Please note that the deletion of your personal information from our database will result in us not being able to provide you with any services. If applicable, any legal requirement on us to maintain certain records of your personal information shall prevail over any of your requests. We may require you to prove your identity before providing you with copies of your personal information.


  7. Changes to our Privacy Policy

    TTPP reserves the right to alter all or any part of this Privacy Policy. Any changes thereto will be notified via the Website and, where appropriate, through e-mail notification.

    Our Website may have links to other websites. This privacy policy only applies to the Website. You should therefore read the privacy policies of the other websites when you are using those sites.

  11. Legal grounds for use of Personal Data

    11.1 The legal grounds for our use of Personal Data are as follows:
    (a) Consent: where you have consented to our use of your Personal Data. You may withdraw your consent to the use of your Personal Data by contacting us as set out in a paragraph of the Privacy Policy.
    (b) Contract performance: where we are required to collect and handle your Personal Data in order to provide you with the services that we have contractually agreed to provide to you, e.g. where you have booked a delivery with us .
    (c) Legal obligation: where we need to use your Personal Data to comply with our legal obligations.
    (d) Vital interests: where we need to process your Personal Data in order to protect the vital interests of you or another natural person.
    (e) Public interest: where we need to process your Personal Data in order to carry out a task that is in the public interest.
    (f) Legitimate interests: where we have a legitimate interest in using your information. We will only rely on this legal ground if we consider that our interest in using your Personal Data for the relevant purpose is not outweighed by any interests that you may have, or any prejudice that you may suffer, from the relevant use of your Personal Data.

    (k) Public interest in area of public health: where we need to process your Personal Data for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health, set out in EU law or the laws of the member state in which you are based.


  12. Profiling

    12.1 In connection with our marketing activities, we analyse some of the information that we collect about our customers (together with information about customers that we collect from our loyalty and other partners) to determine what offers are most likely to be of interest to different categories of customers in different circumstances and at different times. We call this the creation of “segments”. To do this, we combine Personal Data that we have collected from customers directly together with Personal Data that we have collected from our affiliates and other partners, including Deliveroo & Oddle, about our customers’ purchase history and interactions with us. From time to time, we will assess the Personal Data that we hold about you in order to assign you to a particular segment. We will use the segment that you have been assigned to in order to tailor our marketing communications to include offers and content that are relevant to you.
    12.2 You have the right to opt out of our direct marketing, and the underlying analysis of your Personal Data that we use to tailor the direct marketing that we send to you, at any time. You can exercise this right, by contacting us in accordance with a section of the Privacy Policy.


  13. Our decision-making processes

    13.1 In connection with our business, we will use your Personal Data to make various decisions about you and your eligibility to access our services, to prevent abusive use of our services, to ensure security of our systems, or to detect fraud. Some of these decisions may be taken on an automated basis including, by matching your Personal Data against information in certain risk models that we have created based on the behaviour of other individuals and using your Personal Data to further enhance such models.


  14. Retention period

    Our retention periods for Personal Data are based on business needs and legal requirements. We will retain your Personal Data for as long as is necessary for the processing purpose(s) for which it was collected and any other permitted linked purpose. For example, we may retain: (i) certain transaction details (e.g. flight history) and correspondence until the time limit for claims arising from the transaction with us has expired (which is typically between 6 to 10 years after the relevant transaction occurred, and in some cases much less than this); or (ii) certain data to comply with regulatory requirements regarding the retention of such data. Where Personal Data is no longer needed, we either irreversibly anonymise the data (in which case we may further retain and use the anonymised data) or securely destroy the data.


  15. Your rights

    15.1 In addition to the paragraph 15 of the Privacy Policy, in certain circumstances, you may have the rights under EU DP Law to ask us to:
    (a) provide you with further details on how we use and process your Personal Data;
    (b) delete Personal Data we no longer have grounds to process; and
    (c) restrict how we process your Personal Data whilst we consider an inquiry you have raised.
    Please note that we will not charge a fee when we deal with your requests in the exercise of the above rights.
    15.2 In addition, under certain conditions, you have the right to:
    (a) where processing is based on consent, withdraw the consent; and
    (b) object to any processing of Personal Data that we process on the "legitimate interests" or "public interests" grounds, unless our reasons for the underlying processing outweighs your interests, rights and freedoms.
    (c) object to direct marketing (including any profiling for such purposes) at any time.
    15.3 You may exercise these rights by contacting us at the contact details in section [6.4] of the Privacy Policy. Please note that we will not charge a fee when we deal with your requests in the exercise of these rights.
    15.4 These rights are subject to certain exemptions to safeguard the public interest (e.g. the prevention or detection of crime) and our interests (e.g. the maintenance of legal privilege). We will aim to respond to requests within 30 days.
    15.5 If we are unable to resolve an inquiry or a complaint, you have the right to contact the data protection regulator in the country in which you are based.
